1. Acceptance of Terms
By accessing or using the tuta. platform, mobile application, or any related services (collectively, the "Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Use. If you do not agree to these terms, you must not use the Platform.
2. Description of Services
tuta. is an educational technology platform operating in Ghana that connects families seeking academic tutoring with qualified tutors. tuta. acts as an intermediary marketplace — it does not directly provide tutoring services. All tutoring engagements are between the registered tutor and the registered parent or guardian.
3. User Accounts
You must register for an account to access most Platform features. You agree to provide accurate, complete, and current information during registration and to keep your account credentials confidential. You are responsible for all activity that occurs under your account. tuta. reserves the right to suspend or terminate accounts that provide false information or violate these Terms.
4. Roles and Responsibilities
Parents/Guardians are responsible for providing accurate information about their child's educational needs, communicating respectfully with tutors, and ensuring payment obligations are met promptly.
Tutors are responsible for delivering sessions as scheduled, maintaining professional conduct, completing all required onboarding steps including identity verification, and complying with tuta.'s professional standards.
tuta. is responsible for facilitating the matching process, collecting and disbursing payments, handling disputes, and maintaining platform security.
5. Payment and Fees
All payments for tutoring services must be made through the tuta. Platform. Direct payments between parents and tutors outside the Platform are strictly prohibited and constitute a material breach of these Terms. tuta. collects all fees on behalf of tutors and disburses agreed amounts according to the applicable commission schedule.
6. Commission Structure
During the first calendar month of a tutoring engagement ("Month 1"), tuta. retains 40% of all session fees as a platform commission. From the second month onwards ("Month 2+"), tuta. retains 0% — the tutor receives 100% of session fees. A separate monthly platform subscription fee applies to tutors from their first confirmed match.
7. Cancellations and Refunds
Sessions may be cancelled with at least 24 hours' notice without penalty. Cancellations with less than 24 hours' notice may result in a cancellation fee. Once sessions have commenced in any given month, no refunds are available for fees paid for that month. tuta. reserves the right to issue service credits at its discretion in exceptional circumstances.
8. User Conduct
All users agree not to: (a) harass, abuse, or threaten other users; (b) share personal contact information to facilitate off-platform payments; (c) impersonate any person or entity; (d) upload harmful, obscene, or illegal content; (e) attempt to circumvent Platform security measures; (f) use the Platform for any unlawful purpose.
9. Intellectual Property
All content on the Platform, including logos, text, graphics, and software, is the property of tuta. or its licensors and is protected by Ghanaian and international intellectual property laws. Users may not reproduce, distribute, or create derivative works from Platform content without prior written consent from tuta.
10. Limitation of Liability
To the maximum extent permitted by applicable law, tuta. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. tuta.'s total liability for any claim arising under these Terms shall not exceed the total fees paid by you in the three months preceding the claim.
11. Termination
Either party may terminate their account at any time. tuta. reserves the right to suspend or terminate accounts immediately for breach of these Terms, fraudulent activity, or conduct that harms the tuta. community. Upon termination, any outstanding payment obligations survive.
12. Changes to Terms
tuta. may update these Terms of Use from time to time. Users will be notified of material changes and will be required to re-accept updated terms before continuing to use the Platform. Continued use of the Platform after notification constitutes acceptance of the revised Terms.
