Terms of Service

1. About tuta

tuta (operated by Engine8 Studios) ("tuta", "we", "us") operates the tuta platform at usetuta.app — an online marketplace that connects parents and students with independent private tutors in Ghana.

tuta is a platform, not a tutoring company. We facilitate connections between users. We do not employ tutors, guarantee academic outcomes, or act as an agent for either party. Tutors are independent contractors who set their own availability and teaching methods.

By creating an account or using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.

2. Eligibility

  • You must be at least 18 years old to create an account.
  • Parents may use the Platform on behalf of their minor children.
  • Students under 18 may not create their own accounts.
  • Tutors must be at least 18, complete identity verification (KYC), and provide accurate qualification information.
  • You must provide accurate, current, and complete registration information.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately at hello@usetuta.app if you suspect unauthorised access to your account.

You may not share your account with others or create multiple accounts for the same person. We reserve the right to suspend or terminate accounts that violate these Terms.

4. For Parents & Students

Booking & Payments

When you submit a tutoring request, our operations team will match you with a suitable tutor. You will be notified when a match is made. Bookings are confirmed when you accept the proposed schedule.

Fees are as quoted at the time of booking. tuta earns a platform fee included in the quoted price. Pricing may vary by subject, level, and location.

Cancellations & Refunds

Cancellation and refund requests are handled on a case-by-case basis. Contact us at hello@usetuta.app. Session clock-in/out records and evaluations serve as the authoritative record of whether a session was delivered.

We are not liable for sessions that could not take place due to circumstances outside our control (tutor illness, family emergency, etc.). In such cases, we will facilitate rescheduling.

Content & Evaluations

Session evaluations submitted by tutors (attendance, focus, comprehension scores, session notes) are provided for informational purposes only. They are not professional assessments and should not be relied upon for clinical, diagnostic, or academic placement decisions.

5. For Tutors

Independent Contractor Status

You are an independent contractor, not an employee of tuta You are solely responsible for:

  • Your own tax obligations, including income tax on earnings received through the Platform
  • Your teaching methods, materials, and session delivery
  • Your own transportation and safety when travelling to sessions
  • Maintaining your own professional indemnity insurance if you deem it appropriate

Nothing in these Terms creates an employment, agency, partnership, or joint venture relationship between you and tuta

KYC & Verification

You must complete identity verification before being matched with students. You warrant that all information and documents submitted are genuine. Submitting false or fraudulent documents will result in immediate permanent suspension and may be reported to the relevant authorities.

Conduct & Safeguarding

Tutors must at all times:

  • Behave professionally and respectfully toward students and parents
  • Conduct sessions only at the agreed location, time, and with the agreed student
  • Never engage in any form of inappropriate physical, emotional, or sexual conduct with a student
  • Report any safeguarding concerns to tuta immediately

Violation of any safeguarding obligation will result in immediate permanent suspension and referral to the appropriate authorities.

Session Records & Earnings

Earnings are calculated based on completed sessions as recorded in the Platform (clock-in and clock-out records). You are responsible for clocking in and out accurately. Disputes about session records must be raised within 7 days of the session date via the log request process.

tuta reserves the right to withhold or reverse payouts for sessions disputed by the parent or flagged for investigation.

Account Suspension

We may suspend or terminate your account if you: repeatedly miss sessions without notice, receive consistent negative feedback, submit fraudulent session logs, violate our safeguarding obligations, or breach any provision of these Terms. We will endeavour to give you notice except where immediate suspension is necessary to protect a student.

6. Prohibited Conduct

You must not:

  • Use the Platform to solicit tutoring relationships outside of tuta to avoid platform fees, during or within 12 months of a tuta-facilitated introduction
  • Submit false, misleading, or fraudulent information
  • Harass, abuse, or threaten other users
  • Attempt to gain unauthorised access to any part of the Platform
  • Use automated tools to scrape or extract data from the Platform
  • Post or share illegal, harmful, or offensive content
  • Impersonate another person or entity

7. Intellectual Property

The tuta Platform, brand, design, and code are owned by tuta (operated by Engine8 Studios) and protected under applicable intellectual property laws. You may not copy, reproduce, or create derivative works without our written permission.

Content you submit (profile information, session notes, reviews) remains yours. You grant tuta a non-exclusive, royalty-free licence to store, display, and use that content to operate the Platform.

8. Limitation of Liability

To the maximum extent permitted by Ghanaian law:

  • tuta is not liable for the conduct, actions, or omissions of any tutor or parent on the Platform
  • tuta does not guarantee any particular academic outcome or result from tutoring
  • tuta's total liability to you for any claim arising from use of the Platform is limited to the amount you paid to tuta in the 3 months preceding the event giving rise to the claim
  • tuta is not liable for indirect, consequential, special, or punitive damages

Nothing in these Terms excludes liability for death or personal injury caused by our negligence, or for fraud.

9. Disputes Between Users

tuta is not a party to disputes between tutors and parents. We may, at our discretion, assist in facilitating resolution. We are not obligated to resolve disputes and our involvement does not create liability on our part.

10. Governing Law & Jurisdiction

These Terms are governed by the laws of the Republic of Ghana. Any dispute that cannot be resolved informally will be subject to the exclusive jurisdiction of the courts of Ghana.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or in-app notice at least 14 days before they take effect. Continued use of the Platform after that date constitutes acceptance of the updated Terms.
